Blank Rome partner Natalie Alameddine will serve as a panelist for the College of Labor and Employment Lawyers Regional Programming Committee of the 9th Circuit South’s panel discussion program on September 10, 2022, in San Diego, California. The event will be hosted by the Fellows of Paul, Plevin, Sullivan & Connaughton LLP at their offices, with partial sponsorship by Signature Resolution. Two panel discussions will feature current topics of national interest guaranteed to be both informative and valuable.

Natalie’s session, “The Morning After: How Overturning Roe v. Wade May Affect Labor and Employment Law, and Litigating PAGA Claims after Viking River Cruises,” takes place from 8:45 a.m. to 12:00 p.m.

ABOUT THE SESSION

The panel will explore the possible impact of Dobbs v. Jackson Women’s Health Organization on labor and employment law. And it will include an advanced discussion of Viking River Cruises v. Moriana.

Issues raised by Dobbs will include:

  • Potential protection under federal law, including the Pregnancy Discrimination Act and Title VII’s religious accommodation rule, for employees terminated for undergoing abortions.
  • FMLA and disability accommodation rights for employees in abortion prohibition states.
  • Risks for companies that offer travel benefits to employees in abortion prohibition states for out-of-state abortion services, including ERISA preemption defenses.
  • Risks for employees who avail themselves of these types of travel benefits.
  • Medical privacy rights of employees who undergo abortions.

Issues raised by Viking will include:

  • Confusion about the future of standing.
  • Impact on pending PAGA cases.
