Multi-Award Contract Issues May Limit New Bill’s Impact

A new bill that would eliminate price as a consideration in certain multi-award government contracts will give more businesses the opportunity to compete for federal dollars, but existing challenges such as contentious scoring factors and a diminished ability to protest awards may blunt its impact.

The costs associated with preparing those pricing proposals can also be significant, particularly for small businesses, which can dissuade some companies from participating at all, according to Blank Rome LLP partner Stephanie Harden.

"It can be incredibly expensive for small businesses to bid on a task order … [and] anytime you streamline that acquisition process, you can reduce the upfront costs to the small business, which can be a significant barrier to entry into the federal marketplace," Harden said.
