Blank Rome Secures Victory for DePuy Synthes, Enforcing Terms of Non-Compete Agreement against Former Sales Executive

Blank Rome’s trade secret and competition group secured a significant victory for DePuy Synthes, a subsidiary of Firm client Johnson & Johnson, by securing an injunction in the Eastern District of Pennsylvania enforcing the terms of a non-compete against a former senior sales executive, prohibiting him from taking a position with a direct competitor for a period of 18 months.

The case was filed on December 1, 2016, and set for an expedited evidentiary hearing beginning on December 15 through December 19. The court unequivocally held that the non-compete was enforceable under New Jersey law, and that the injunction would not only prevent serious, irreparable harm to DePuy Synthes, but it would also be in the public’s interest.
