Blank Rome Represents Maritime Defense Contractor SeaChange Projects LLC

Blank Rome successfully represented maritime defense contractor SeaChange Projects LLC in a lawsuit it brought against the United States of America.

Throughout the past two years of litigation, SeaChange maintained that USA’s Military Sealift Command (“MSC”) awarded SeaChange a classified maritime contract, despite the fact that MSC knew or should have known that SeaChange would be unable to obtain the necessary security clearance before the vessel would be required to sail. After SeaChange incurred millions of dollars to procure and prepare the vessel to fulfill the contract, MSC terminated the contract for default due to SeaChange not yet having the security clearance.

Last week, the case went to trial in the U.S. District Court for the District of Delaware. After four days of evidence, the government conceded to our client’s settlement demands by agreeing to:

(1) convert the termination for default to a termination for convenience;
(2) drop MSC’s counterclaim for reprocurement costs in the amount of $1.3M; and
(3) pay SeaChange the amount it was entitled to under the terms of the contract for a termination for convenience in the amount of $5.2M.
