Advanced Patent Prosecution Workshop 2011: Claim Drafting and Amendment Writing

Jay Lessler, partner in Blank Rome's intellectual property practice, will be co-chairing and speaking at Practicing Law Institute's Advanced Patent Prosecution Workshop 2011: Claim Drafting and Amendment Writing on July 13-14, 2011 in New York City.

This year's workshop will provide attendees with the opportunity to receive drafting experience under the guidance of experienced patent prosecutors. Registrants will work in small technologically-distinct groups, and will receive individualized feedback on claim drafting and amendment writing skills and learn practical techniques for avoiding prosecution pitfalls. Guidance on recent changes in the U.S. Patent and Trademark Office (USPTO), and important cases, e.g., the United States Supreme Court cases of Global Tech v. SEB (intent for inducing infringement) and Microsoft v. i4i (standard of proof for obviousness); the Federal Circuit case of Therasense v. Becton Dickinson (inequitable conduct standard); and the USPTO’s new guidelines on obviousness and patentable subject matter will be presented. Course material will include sample problems and model solutions.

On July 14, Mr. Lessler will begin the morning session at 9:00 a.m. with a Supreme Court Update. He will discuss the Supreme Court’s review of the clear and convincing standard for patent invalidity (in Microsoft v. i4i) and the legal standard for actively inducing infringement under 35 U.S.C. §271(b) (in Global-Tech Appliances v. SEB S.A.).
