Criminal Enforcement for Negligent Conduct

Greg Linsin, partner in Blank Rome's maritime group, will be speaking at the Admiralty Law Institute conference on Thursday, March 24 at the Tulane University School of Law in New Orleans, Louisiana.  He will present on the pollution panel on the subject of "Criminal Enforcement for Negligent Conduct."

Mr. Linsin's presentation will incorporate the following topics:

  • the legal standard of negligent criminal liability, including the Clear Water Act, as amended by OPA 90, the Refuse Act, and the Migratory Bird Treaty Act
  • policies and procedures affecting oil spill enforcement from the U.S. Coast Guard, Department of Justice, and EPA
  • criminal prosecutions in the wake of oil spill events
  • factors that have influenced exercise of prosecutorial discretion
  • issues of significance in future cases

The Admiralty Law Institute is the oldest (since 1966) and largest continuing legal education program devoted to maritime law.  The Institute convenes every other March for three days on the campus of Tulane University and brings together hundreds of lawyers, both practicing and academic, to present papers and presentations that are subsequently published in the Tulane Law Review.  Recent Institutes have typically been attended by 500 lawyers and others from the shipping and marine insurance industries, from over 30 states and 11 countries.  To learn more about the Admiralty Law Institute, please click here.
