Marilyn Chinitz, partner in Blank Rome’s matrimonial group, was quoted in Business Insider about the pending nuptials between singer Miley Cyrus and actor Liam Hemsworth.
"They're very young and there's more of a chance that they'll get divorced under those circumstances," Ms. Chinitz said. "She's probably more protected at this juncture in her life but we don't know what's going to happen. We don't know who will wind up being the wealthier spouse."
At the age of 19, Ms. Cyrus is an estimated billion-dollar franchise from her years doubling as Disney's Hannah Montana. Mr. Hemsworth is a rising star, landing the coveted role in the “Hunger Games” franchise, as well as a string of upcoming blockbusters.
The couple’s decision on whether to get a prenuptial agreement will depend on where they choose to live, as community property laws vary by state. If they choose to live in Mr. Hemsworth’s native Australia, they should draw up a mirrored prenuptial agreement, which would ensure whatever prenup they've filed in the states will transfer smoothly overseas.
"Laws (abroad) are very different than they are in the U.S. ...You want to be sure wherever you go that you have an agreement the court recognizes as fair and reasonable," she said. "Why protect all of these assets if a court's just going to throw it out?"
