They will discuss best practices for resolving claims efficiently, protecting privilege, avoiding costly claim mistakes, and managing clients, brokers, consultants, and insurers; damage considerations and proven loss calculation methodologies; contingent time element disputes; causation and mitigation issues; liability disputes; declared values; ADR; and key policy language to update before a costly loss.

Plenary: Potential Conflicts: The Defense Counsel’s Duty to Zealously Defend the Insured v. The Insurer’s Right to Control Litigation Costs

A panel discussion with a moderator, two in-house/carrier lawyers, and two insurance defense lawyers. The panel will discuss various ethical and practical concerns regarding Counsel’s Duty to Zealously Defend the Insured v. The Insurer’s Right to Control Litigation Costs. The program will challenge attendees to consider how they can zealously defend their insured clients and follow their jurisdiction’s ethical rules while simultaneously following the insurer’s guidelines and keeping the insurer happy with the costs. Different jurisdictions’ ethical rules and case law will be discussed with a focus on Texas and New York law.
